GENERAL DECLARATION

As a driver or entrant, or an official representative of that driver or entrant, the applicant declares that:

1) The listed driver/entrant wishes to register for the 2024 Radical Cup North America series and declares that the information given above is correct. Should any of the supplied information change, updated details must be sent in writing to the Series Organizers via [email protected] .

2) All named understands it is their responsibility to read, understand and abide by all provisions, including those supplemented or amended from time to time, to the 2024 Radical Cup North America series Sporting and Technical Regulations, Supplementary Regulations, Bulletins, Memorandums and Materials uploaded to https://files.usacnation.com/2024/Radical%20Cup

3) All named are physically and mentally fit to take part in the event and are competent to do so.

4) All named acknowledge they understand the nature and type of the competition and the potential risk inherent in motorsport and agree to accept that risk. Furthermore they understand that all persons having any connection with the promotion and/or organization and/or conduct of the event are insured against loss or injury caused through their negligence.

5) All named acknowledge they understand determinations by Radical Motorsport Ltd and/or USAC officials are non-litigable; Drivers and competitors will not initiate or maintain litigation of any kind against Radical Motorsport Ltd, the United States Auto Club ("USAC"), or anyone acting on behalf of USAC, to reverse, or modify, such determinations, or to seek to recover damages, or other relief allegedly incurred, or required, as a result of such determination and; if a participant, entrant, competitor, or official initiates, or maintains, litigation in violation of this provision, that individual or entity agrees to reimburse Radical Motorsport Ltd, USAC, for all costs of such litigation, including travel expenses, and attorneys’ fees. Competitors, or officials, involved in such litigation as plaintiffs will have all USAC privileges suspended until litigation is complete.

6)) To the best of my belief the driver(s) possess(es) the standard of competence necessary for an event of the type to which this entry relates and that the vehicle entered is suitable and roadworthy for the event having regard to the course and the speeds which will be reached.

7) All named understand that should they, at the time of an event, be suffering from any disability whether permanent or temporary which is likely to affect prejudicially their normal control of my vehicle, they may not take part unless they have declared such disability to the ASN which has, following such declaration issued a license which permits them to do so.

8) Any application form for a license which was signed by a person under the age of 18 years will not be valid until a form countersigned by that person’s parent/guardian/guarantor, whose full names and addresses have been given, is issued to Series Organizers.

9) If I am the Parent/Guardian/Guarantor of the driver I understand that I have the right to be present during any procedure being carried out under the Supplementary Regulations issued for this event and the Sporting and Technical Regulations.

10) All named agrees to permit the USAC, Radical Motorsport Ltd and its assigns (including, but not limited to, subsidiaries, series sponsors, promoters/organizers of the Event), free of any charges, duties or fees, to use, license, reproduce, have reproduced, show, have shown, without limitation in space or time, all drawings, soundtracks, photographs, trademarks, films/video pictures concerning competitors, their drivers, teams or cars involved in the event(s) on any medium whatsoever for any documents, reports, coverage, broadcast, program, publication, video game or model production, software, etc. whether past, present or future. The Applicant further acknowledges and agrees that USAC and/or Radical Sportscars Ltd may freely assign or License its rights to a third party.

11) All named understand that they will be financially responsible for any damage caused to the track, or clean-up products used, as a result of an incident of which the listed driver/entrant is involved (such as but not limited to guardrail replacement, oil-dry, repair to paddock pavement)

12) All named understand Entry Fees are non-refundable. The inability to attend, for any reason, does not warrant a refund. In the case the entire event needs to be postponed or moved to a new venue, and may be held on a different date during the same calendar year, entry fees paid shall be transferred to the new date. In the case that an event is cancelled entry fees paid shall, in the first instance, be transferred in full to another event, or in the second instance refunded. Once it has commenced, if an event is stopped for any reason, no entry fees will be refunded.

13) All named acknowledge and agree that global health situations such as pandemics may lead to the postponement, cancellation or stopping of an event, which shall be considered force majeure.

14) All named acknowledged that event organizers, Radical Motorsport, USAC, and the venue are not liable for any potential transmission of illnesses. All named here by confirm they are solely responsible for their own health. All named confirm they will follow all guidelines issued by officials, minimize interactions with others, practice social distancing, wear a mask at all times, regardless of whether those guidelines supersede local or federal mandates. All named confirm they will not attend an event if they feel ill or exhibit symptoms, believe they have been exposed to, or have tested positive to a serious contagious illness within 14 days of the event.
